According to RPORC (Russian Public Opinion Research Center), a third of Russians (32%) do not trust artificial intelligence technologies. Their fears are not unfounded – the spread of deepfakes, AI-covers and other generative AI products has shown the threats posed by uncontrolled technological development. For AI to do more good than harm, it is necessary to develop and integrate the right mechanisms for its regulation.

In 2020, the Russian government approved the Concept for the Regulation of AI and Robotics. It will allow to develop the technology and respect the rights of citizens, to ensure the safety of individuals, society and the state.

The main stages of regulatory control for AI:

  • Creation of the basis for legal regulation of new social relations formed in connection with the use of AI

Regulatory and legal acts

Regulation in the field of AI is carried out on the basis of the instructions of the President of the Russian Federation.

  • Establish mandatory requirements for increasing the efficiency of business entities and their mandatory use of modern technologies, including AI technologies (if such entities are granted subsidies from the federal budget)
  • Introduce amendments to the educational programs of higher education institutions that will increase the level of competence in the field of AI for specialists in key sectors of the economy and social sphere, as well as for specialists in state and municipal management
  • Make changes to national projects and state programs that provide for the deployment of AI technologies in each sector
  • Adjust strategies for digital transformation of economic sectors
  • Monitor the results of the use of AI technologies
  • Ensure the participation of the Federal Center of Competences in the Sphere of Labor Productivity in the deployment of AI technologies and modern management systems in sectors of the economy, social sphere and state bodies
  • Approve the federal project for the development of domestic robotics: define legal, tax and other conditions concerning the development of production in this sphere, measures of state support, target parameters for the development of production and introduction of industrial robots
  • Extend the support for the activities of research centers in the field of AI up to 2023
  • Include measures to introduce AI technologies as a priority in the investment development programs of companies with state participation
  • The Government of the Russian Federation, together with the Alliance for Artificial Intelligence Association, should ensure:
    • changes to the established norms that hinder AI deployment in economic and social sectors
    • creation of more favorable conditions for export of domestic AI products
    • expansion of the list of territories where unmanned aircraft systems are tested
    • establishment of awards for young scientists and engineers for breakthrough solutions in the field of AI, as well as for domestic companies for successful implementation of the technology
    • creation of a list of relevant technological trends in the field of AI
    • introduction by economic entities of a unified system of evaluation of domestic solutions with AI technologies
    • creation of a rating of universities in terms of the quality of training of specialists in the field of AI
    • develop and implement measures to develop and introduce domestic cloud technologies and platforms
  • The Government of the Russian Federation, together with the commissions of the State Council of the Russian Federation, the Federal Center of Competences in the Field of Labor Productivity and the Artificial Intelligence Alliance Association, to ensure the transition of the system of state power at the federal and regional levels to a management model based on automatic data collection and analysis using information platforms
  • The Presidential Administration of the Russian Federation, together with the Government and the Alliance for Artificial Intelligence, should prepare a draft presidential decree on amending the National Strategy for the Development of Artificial Intelligence for the period until 2030, including for the widespread AI deployment
  • The Russian Ministry of Health, the Russian Ministry of Economic Development and the Russian Ministry of Digital Development to ensure:
    • the use of AI-assisted medical research results in clinical results to the system of OMS
    • creation of open databases with anonymized medical information
  • Commissions of the State Council of the Russian Federation to introduce the most successful practices of AI use in the constituent entities of the Russian Federation
  • The Federal Tax Service of Russia, together with the Ministry of Economic Development and the Ministry of Digitization, to take measures aimed at ensuring the effective application of the tax incentives mechanism for entrepreneurs who have implemented advanced domestic information and telecommunication technologies
  • Recommend to the Alliance for Artificial Intelligence Association to submit proposals on additional measures to support AI projects and specialists, to provide domestic software developers with access to databases for the development of AI programs, and to advise organizations
  • Rosatom State Corporation together with Russian Railways and with the participation of the Ministry of Industry and Trade of Russia and Sberbank of Russia and leading research universities in the field of artificial intelligence to hold conferences on the use of new computing and data transfer technologies
  • The Ministry of Industry and Trade of Russia to hold conferences on the use of new industrial technologies starting from 2023
  • Recommend to the State Duma to consider a draft federal law establishing a procedure for anonymizing personal data

In addition to the instructions of the President of the Russian Federation, AI in Russia is regulated by decrees of the President of the Russian Federation, resolutions and orders of the Government of the Russian Federation and the Ministry of Transportation of the Russian Federation.

Experimental legal regimes

AI development is also supported through the introduction of experimental legal regimes (ELRs)

  • Federal Law No. 258-FZ dated 31.07.2020 "On experimental legal regimes in the sphere of digital innovation in the Russian Federation"

Standardization

Standardization in AI is necessary in order to:

  • Streamline the AI integration process
  • Ensure consistently high quality of AI products
  • Increase the competitiveness of domestic products and services

For this purpose, standards for the development and implementation of AI are being introduced in Russia. The standardization policy follows the program adopted by Rosstandart for the priority area "Artificial Intelligence".

It includes the development of at least 111 standards, which are designed to overcome regulatory and technical barriers in the implementation of the federal project "Artificial Intelligence".

Technical Committee for Standardization No. 164 "Artificial Intelligence" was also established to improve the efficiency of standardization work. The committee includes more than 120 specialized companies and government agencies.

Ethics

Lack of proper regulation of the use of artificial intelligence can lead to the spread of misinformation, discrimination, and a detrimental impact on democratic processes.

To avoid this, in 2021, experts from the AI Alliance developed the Code of Ethics in the Field of AI.

The Code establishes general ethical principles and standards of behavior that should guide the participants of relations in the field of AI, and is intended to create an environment of trusted development of AI technologies in Russia.

Main provisions of the Code:

  1. The main priority for the development of AI technologies lies in protecting the interests and rights of people and the individual person
  2. It is necessary to realize responsibility when creating and using AI
  3. Responsibility for the consequences of the use of AI is always the responsibility of the individual
  4. AI technologies should be used for their intended purpose and implemented where it will benefit people
  5. The interests of AI technology development are above the interests of competition
  6. It is important to maximize transparency and truthfulness in informing about the level of development of AI technologies, their opportunities and risks
The Code was adopted at the First International Forum "Ethics of Artificial Intelligence: The Beginning of Trust" in 2021.
